purchase, in which case you still might not be completely clear of exactly what the conveyancing process entails.<\/p>\n<p>You\u2019re not alone.<\/p>\n<p>So to help, in this article, we\u2019ll outline the meaning of conveyancing, including what conveyancing is, what a conveyancer does, and why you need one, and also a detailed explanation of the steps involved in the conveyancing process so you\u2019re prepared when the time comes around to use one.<\/p>\n<h2><span class=\"toc_link\" id=\"what-is-conveyancing-in-real-estate\">What is conveyancing in real estate?<\/span><\/h2>\n<p>Let's start with the basics. <div class=\"adplugg-tag\" data-adplugg-zone=\"the_sentiment_campaign_body_\"><\/div><\/p>\n<p>The definition or meaning of conveyancing and conveyancing services is <em>the part of the law involved with preparing documents for the conveyance of property<\/em>.<\/p>\n<p>In other words, it\u2019s the legal process of transferring ownership of a property from the current owner (vendor or seller) to a new owner (purchaser or buyer).<\/p>\n<p>Generally, a conveyancing transaction consists of three main stages:<\/p>\n<ol>\n<li>Pre-contract<\/li>\n<li>Pre-completion<\/li>\n<li>Post-completion<\/li>\n<\/ol>\n<p>These three steps include any work needed when buying or selling a property, subdividing land, updating a title, or registering or changing an easement.<\/p>\n<p>This can include assisting the transfer of ownership, including home loans and any other conveyancing activity.<\/p>\n<p>It\u2019s interesting to note that conveyancers don\u2019t necessarily have to be solicitors, but they can undertake the same type of work.<\/p>\n<p>However, I\u2019d like to point out that while conveyancers specialise in a title transfer, I prefer working with a solicitor who specialises in property conveyancing.<\/p>\n<p>You might ask why?<\/p>\n<p>Generally, conveyancers have detailed knowledge in one area of the law, property law.<\/p>\n<p>On the other hand, solicitors have specific knowledge about property law but also broader knowledge of the law in general.<\/p>\n<p>This difference in knowledge and experience is what commonly creates a price difference between conveyancers and solicitors, but when or if something goes wrong, and unfortunately occasionally it happens, in general, it is better to have a legal firm and solicitor working on your side.<\/p>\n<h2><span class=\"toc_link\" id=\"what-does-a-conveyancer-do\">What does a conveyancer do?<\/span><\/h2>\n<p>Now that we know what conveyancing is, we can look at what a conveyancer actually does.<\/p>\n<p>A conveyancer is the person who oversees, and manages, the actual transaction of the sale of a property from a seller to a buyer and manages the preparation of any legal documents needed for the transaction.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter to ensure the documents comply with legal regulations in your state or territory.<\/p>\n<p>The role and timing of the conveyancer\u2019s work do differ from state to state but generally speaking, it involves preparing or reviewing a sales contract, home loan, and other related documents needed when someone is buying or selling a home, land, or investment property.<\/p>\n<p>It might sound straightforward enough but there is a significant amount of work involved.<\/p>\n<p>For someone who doesn\u2019t know the process and how to tackle conveyancing steps effectively, it could take weeks to find, lodge, and understand each individual legal document.<\/p>\n<h2><span class=\"toc_link\" id=\"what-do-conveyancers-check\">What do conveyancers check?<\/span><\/h2>\n<p><strong>And how does it differ for the buyer or seller?<\/strong><\/p>\n<p>Obviously, every property transaction has a buyer and a seller, and they both need a conveyancer or solicitor to represent them in the conveyance property and its certificate of title \u2013 check for easements, type of title, and any other information which is needed<\/li>\n<li>Put the deposit money in a trust account<\/li>\n<li>Prepare and lodge legal documents, such as a contract or sale, vendor disclosure, and memorandum of transfer<\/li>\n<li>Calculate any adjustments of rates and taxes, <a href=\"https:\/\/propertyupdate.com.au\/understanding-stamp-duty\/\" target=\"_blank\" rel=\"noopener\">stamp duties<\/a>, and other financial obligations<\/li>\n<li>Settle the property \u2013 a conveyancer will act on a buyer\u2019s behalf, advise when the property is settled, and contact your bank or financial institution when final payments are being made<\/li>\n<li>Represent your interest with a vendor or their agent<\/li>\n<\/ul>\n<p><em>For a seller, a conveyancer will do the following:<\/em><\/p>\n<ul>\n<li>Complete legal documents<\/li>\n<li>Confirm the seller is the legitimate owner<\/li>\n<li>Review the contract of sale and vendor disclosure statement to look for any unusual clauses or raise any red flags<\/li>\n<li>Check the property meets council standards<\/li>\n<li>Give any advice on conditions that could protect you during the process<\/li>\n<li>Arrange any finances if necessary<\/li>\n<li>Arrange payments of deposits and stamp duties<\/li>\n<li>finding out if any government authority has a vested interest in the land or if any planned development could affect the property<\/li>\n<li>finding out any information that may not have been previously disclosed such as a fence dispute or illegal building work<\/li>\n<li>Represent you and your interest in dealings with the buyer, such as asking questions, finding out information, requesting extensions, etc.<\/li>\n<\/ul>\n<h2><span class=\"toc_link\" id=\"do-i-need-a-conveyancer-before-making-an-offer\">Do I need a conveyancer before making an offer?<\/span><\/h2>\n<p>So we\u2019ve ironed out what conveyancing is, what a conveyancer does, and what a conveyancer checks.<\/p>\n<p>But do you know when you should engage with one?<\/p>\n<p>Here are nine examples of when you may need to engage a conveyancer<u>\u2019s <\/u>services:<\/p>\n<ul>\n<li>Buying and selling property<\/li>\n<li>Leasing<\/li>\n<li>Subdivision of land<\/li>\n<li>Buying an apartment or house off the plan<\/li>\n<li>Updating a Title due to Divorce or death (or Will)<\/li>\n<li>Registering, changing, or removing an Easement<\/li>\n<li>Checking a Company Title<\/li>\n<li>Tenants in common apartments<\/li>\n<li><a href=\"https:\/\/propertyupdate.com.au\/what-is-land-tax-and-can-i-reduce-it\/\" target=\"_blank\" rel=\"noopener\">Land tax<\/a> &amp; Stamp Duty advice<\/li>\n<\/ul>\n<p>So, do you need one before making an offer, or can you bring them in once the process has started?<\/p>\n<p>In short, whether you are the seller or the purchaser of a property you will need the services of a conveyancer, so it's always best to engage with one sooner rather than later.<\/p>\n<p>While I\u2019ve heard of buyers and sellers who attempt to undertake conveyance duties themselves, it is inadvisable to do so, in fact, it makes no sense to do so given the complexities and regulations surrounding real estate transactions.<\/p>\n<p><img efficiently prevent a buyer from buying a \u2018dud\u2019 property.<\/p>\n<p>For sellers, a conveyancer can help prepare the offer and sales contract as well as organise any other legally required documentation.<\/p>\n<p>They can also assist in determining the most advantageous settlement date long before negotiations with any prospective buyer begins.<\/p>\n<p>For buyers, a conveyancer often only becomes involved in the transaction when a contract of a sale has been signed.<\/p>\n<p>So in my opinion, their legal expertise should be utilised <em>beforehand<\/em> to verify any issues around boundaries, planning restrictions or any legal issues which can drastically alter a property\u2019s potential.<\/p>\n<h2><span class=\"toc_link\" id=\"can-you-change-the-conveyancer-before-settlement\">Can you change the conveyancer before settlement?<\/span><\/h2>\n<p>On the odd occasion, some buyers or sellers will look at changing conveyancer mid-way through a sale or before settlement.<\/p>\n<p>Perhaps they decide they\u2019ve chosen the wrong conveyancer?<\/p>\n<p>Maybe they\u2019re unhappy with their conveyancer, the service they\u2019ve received, or the speed at which the work is being done.<\/p>\n<p>Or maybe they have even been charged for work not done, have missed the cooling-off period or essential searches haven\u2019t been done.<\/p>\n<p>It\u2019s hard to believe but, unfortunately, some conveyancers cut corners, fail to give the right advice, miss doing important searches, are late transferring funds, 300w\" sizes=\"auto, (max-width: 499px) 100vw, 499px\" \/><\/p>\n<p>In which case, of course, their client would want to look to change conveyancer before settlement.<\/p>\n<p>And it\u2019s certainly possible to do.<\/p>\n<p>Depending on what stage of the process you are in, it could be a simple move or something a bit more tricky.<\/p>\n<p>Generally, the earlier in the transaction the simpler a change can be.<\/p>\n<p>First, you should try to resolve any issues by voicing or elevating any concerns.<\/p>\n<p>If that doesn\u2019t resolve the issue, then before proceeding you need to work out the following:<\/p>\n<p><strong>1. Is there a penalty for switching to a new conveyancer?<\/strong><\/p>\n<p>So long as contracts haven\u2019t been exchanged, there should be no penalty unless set out in your contract. There could however be penalties associated with delayed completion.<\/p>\n<p><strong>2. Do I need to pay for work already completed?<\/strong><\/p>\n<p>Your contract will state whether or not the conveyancer is working under a \u2018no completion, no fee\u2019 arrangement or whether you are liable for work already done.<\/p>\n<p><strong>3. How can paperwork and funds be transferred?<\/strong><\/p>\n<p>Depending on whether you need to pay for work already completed will dictate how willing and quickly a conveyancer will transfer paperwork and funds to a new conveyancer.<\/p>\n<h2><span class=\"toc_link\" id=\"how-to-pick-a-conveyancer\">How to pick a conveyancer<\/span><\/h2>\n<p>In order to avoid going down the troubled route of changing a conveyancer mid-way through the process of buying or selling a house, it is recommended you do your research and ask questions to make sure you\u2019re picking the best person for the job.<\/p>\n<p>Here are a few examples of questions to ask:<\/p>\n<ol>\n<li>How long have you been practising?<\/li>\n<li>What are your qualifications?<\/li>\n<li>Do you have property experience?<\/li>\n<li>Do you hold current professional indemnity insurance?<\/li>\n<li>Have you ever had any malpractice suits?<\/li>\n<li>Are you up to date with developments and technology in order to deliver the best service?<\/li>\n<li>What are your fees and what do they include?<\/li>\n<li>Are there any extra outgoings I might be charged?<\/li>\n<li>What are the Government fees?<\/li>\n<li>Can I speak with any of your clients for a testimonial about your work? signed<\/strong><\/p>\n<p>The buyer\u2019s conveyancer will then prepare a transfer of property, or land, the document which is then signed by the buyer.<\/p>\n<p><strong>Step six: Stamp duty is paid<\/strong><\/p>\n<p>This is a \u201cone-off\u201d tax on certain transactions imposed by state and territory governments.<\/p>\n<p>It can vary depending on the state or territory and may be called transaction.<\/p>\n<p><strong>Step seven: Transfer documents are stamped<\/strong><\/p>\n<p>Once the buyer\u2019s conveyancer prepares the transfer document, has the buyer sign it, and pays any stamp duty for the registration, they must then send the transfer documents to the seller or the seller\u2019s representative for them to sign and stamp before settlement.<\/p>\n<p>The buyer\u2019s conveyancer must arrange for the transfer document to be stamped prior to settlement so the buyer can lodge it for registration immediately after settlement in order to organise the home loan promptly.<\/p>\n<p>This is often a prerequisite of a lender for the transfer and so the home loan can be registered promptly.<\/p>\n<p><strong>Step eight: Insurance is taken out by the buyer<\/strong><\/p>\n<p>The seller is responsible for damage to the property until settlement or completion of the sale, and it is often recommended a buyer insure the property from then onwards because once the property title is transferred, the buyer is then responsible for any damage.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-post-fullsize wp-image-147215 title\u2019 (formal questions about the property)<\/strong><\/p>\n<p>The period of time between the purchase of the property and settlement varies by state and territory and typically ranges between 30-90 days.<\/p>\n<p>At this point, in some states, the buyer\u2019s conveyancer can send a list of formal questions to the seller (known as \u2018requisitions on title\u2019) in order to get any information that the seller might not have previously disclosed or had discovered.<\/p>\n<p>But, in Queensland and Victoria the \u2018requisitions on title\u2019 have been replaced by warranties in the contract.<\/p>\n<p><strong>Step ten: A final search for defects is made<\/strong><\/p>\n<p>While the \u2018requisitions on title\u2019 may dig up any neighbourly disputes or issues, the buyer\u2019s conveyancer will also often do additional searches to make sure there aren\u2019t any general defects in the title, that the land isn\u2019t contaminated and whether there has been any unapproved construction on the property.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-post-fullsize wp-image-116069 img-responsive\" sale of the contract, the buyer may be able to withdraw the<\/p>\n<p>contract, ask for a price reduction, or even sue for damages.<\/p>\n<p><strong>Step eleven: The seller will calculate the final home loan payments<\/strong><\/p>\n<p>If the seller has a home loan on the property, their conveyancer will contact their financial institution in order to get a pay-out figure, attend a settlement to hand over a discharge of the home loan, and often also a certificate of title deed.<\/p>\n<p><strong>Step twelve: Settlement adjustments will be calculated<\/strong><\/p>\n<p>The next step is for the buyer\u2019s conveyancer to calculate adjustments up until the date of settlement which is then agreed upon by the seller\u2019s representative.<\/p>\n<p>The buyer must pay an additional amount to the seller to cover payments already made for the time they will own the property.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-post-fullsize wp-image-145693 img-responsive\"
