{"id":188752,"date":"2025-05-03T15:30:04","date_gmt":"2025-05-03T05:30:04","guid":{"rendered":"https:\/\/propertyupdate.com.au\/?p=188752"},"modified":"2025-04-28T10:16:46","modified_gmt":"2025-04-28T00:16:46","slug":"nsws-pet-reform-turning-investment-properties-into-zoos","status":"publish","type":"post","link":"https:\/\/propertyupdate.com.au\/nsws-pet-reform-turning-investment-properties-into-zoos\/","title":{"rendered":"NSW\u2019s Pet Reform: Turning Investment Properties into Zoos?"},"content":{"rendered":"<p class=\"\" data-start=\"266\" data-end=\"598\">The NSW Government has just delivered another blow to property investors, and this time it's not about rental caps or land tax\u2014it\u2019s about pets.<\/p>\n<p class=\"\" data-start=\"266\" data-end=\"598\">Yes, pets.<\/p>\n<p class=\"\" data-start=\"266\" data-end=\"598\">But not just one or two.<\/p>\n<p class=\"\" data-start=\"266\" data-end=\"598\">Under new tenancy reforms, landlords must now allow up to <strong data-start=\"512\" data-end=\"520\">four<\/strong> animals in their rental properties\u2026 and, in some cases, potentially even more.<\/p>\n<p class=\"\" data-start=\"600\" data-end=\"797\">This isn\u2019t satire.<\/p>\n<p class=\"\" data-start=\"600\" data-end=\"797\">It\u2019s the latest in a string of poorly thought-through policies dressed up as tenant protections, but which, in reality, risk pushing our fragile rental market into deeper crisis.<\/p>\n<p class=\"\" data-start=\"799\" data-end=\"936\">And once again, the investor\u2014the person providing the roof over someone\u2019s head\u2014is painted as the villain and told to \"just deal with it\".<\/p>\n<p class=\"\" data-start=\"938\" data-end=\"1026\">Let\u2019s unpack what\u2019s happening here, why it matters, and what the likely fallout will be.<\/p>\n<p data-start=\"938\" data-end=\"1026\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-177372 img-responsive\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2023\/08\/pets2.jpg\" alt=\"Pets2\" width=\"800\" height=\"450\" srcset=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2023\/08\/pets2.jpg 800w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2023\/08\/pets2-300x169.jpg 300w, https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2023\/08\/pets2-600x338.jpg 600w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><\/p>\n<h2 data-start=\"938\" data-end=\"1026\"><span class=\"toc_link\" id=\"what-the-new-rule-actually-says\">What the new rule actually says<\/span><\/h2>\n<p class=\"\" data-start=\"1070\" data-end=\"1140\">Under the <a href=\"https:\/\/www.nsw.gov.au\/departments-and-agencies\/fair-trading\/changes-to-rental-laws#\" target=\"_blank\" rel=\"noopener\">new regulations<\/a> announced on 4 April 2025,\u00a0 in NSW:<\/p>\n<blockquote><p>The new laws will make it easier for renters to keep pets in their home. A landlord will only be able to refuse a pet for certain reasons.<\/p>\n<p>Landlords will need to provide a written response to a pet request within 21 days. If they do not respond, the request will be automatically approved.<\/p>\n<p>Landlords will be able to refuse the request if:<\/p>\n<ul>\n<li>there would be too many animals at the property<\/li>\n<li>the property is unsuitable for the animal because of the fencing, or lack of open space, or because it would harm the animal\u2019s welfare<\/li>\n<li>the animal is likely to cause more damage than the bond could repair<\/li>\n<li>the landlord lives at the property<\/li>\n<li>keeping the animal would break other laws, local council rules, strata or community scheme by-laws, or a residential community rule<\/li>\n<li>the renter did not agree to a reasonable condition for keeping the animal.<\/li>\n<\/ul>\n<p>There will be limits on the kinds of conditions a landlord may ask for. For example, a landlord will not be able to ask a renter to increase the bond or the rent as a condition for allowing the pet.<\/p>\n<p>Strata by-laws that ban all pets are not valid and cannot be used as a reason to refuse a pet.<\/p>\n<p>If a renter disagrees with a decision, they will be able to apply to the NSW Civil and Administrative Tribunal.<\/p>\n<p>Once consent to keep a pet has been given, consent continues at that property for the life of the animal, even if the landlord or agent changes.<\/p>\n<p>Landlords and agents will also not be able to state in an advertisement that no pets are allowed at a rental property.<\/p>\n<p>These changes do not apply to purpose-built student accommodation.<\/p>\n<p>The changes to keeping pets in rental homes will start on 19 May 2025.<\/p><\/blockquote>\n<p>This means:<\/p>\n<ul data-start=\"1142\" data-end=\"1504\">\n<li class=\"\" data-start=\"1142\" data-end=\"1288\">\n<p class=\"\" data-start=\"1144\" data-end=\"1288\"><strong data-start=\"1144\" data-end=\"1201\">The new laws will make it easier for renters to keep pets in their home.\u00a0<\/strong>A landlord will only be able to refuse a pet for certain reasons. Landlords will need to provide a written response to a pet request within 21 days. If they do not respond, the request will be automatically approved.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1142\" data-end=\"1288\">\n<p class=\"\" data-start=\"1144\" data-end=\"1288\"><strong data-start=\"1144\" data-end=\"1201\">A landlord can refuse for several reasons <\/strong>it is the tenant who would seek an NCAT order should they wish to dispute the landlords decision to refuse or the conditions of keeping the pet set by the landlord.<\/p>\n<\/li>\n<li class=\"\" data-start=\"1142\" data-end=\"1288\"><strong data-start=\"1291\" data-end=\"1341\">Landlords must permit tenants to keep up to four animals<\/strong>\u2014whether they\u2019re dogs, cats, rabbits, or other pets\u2014<em data-start=\"1393\" data-end=\"1401\">unless<\/em> they can prove it\u2019s unreasonable.<\/li>\n<li class=\"\" data-start=\"1436\" data-end=\"1504\">\n<p class=\"\" data-start=\"1438\" data-end=\"1504\">And that key word\u2014<strong data-start=\"1456\" data-end=\"1472\">\u201creasonable\u201d<\/strong>\u2014is where it gets legally fuzzy.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"1506\" data-end=\"1847\">For example, if a landlord objects to pets based on property type, strata rules, or insurance clauses, those may be overridden if deemed \u201cunreasonable\u201d.<\/p>\n<p class=\"\" data-start=\"1506\" data-end=\"1847\">But who determines that?<\/p>\n<p class=\"\" data-start=\"1506\" data-end=\"1847\">NCAT.<\/p>\n<p class=\"\" data-start=\"1506\" data-end=\"1847\">A tribunal member, not a housing or legal expert.<\/p>\n<p class=\"\" data-start=\"1506\" data-end=\"1847\">One person\u2019s subjective opinion will now set a precedent for what\u2019s acceptable in your investment property.<\/p>\n<p class=\"\" data-start=\"1849\" data-end=\"2072\">The guidelines also require landlords to provide a \"suitable environment for pets\", meaning modifications to make the property more animal-friendly\u2014think pet doors, fencing, and flooring adjustments.<\/p>\n<p class=\"\" data-start=\"1849\" data-end=\"2072\">All on the investor\u2019s dime.<\/p>\n<h2 data-start=\"1849\" data-end=\"2072\"><span class=\"toc_link\" id=\"lets-talk-practicalities\">Let\u2019s talk practicalities<\/span><\/h2>\n<p class=\"\" data-start=\"2110\" data-end=\"2153\">Here\u2019s the real-world impact for investors:<\/p>\n<ul data-start=\"2155\" data-end=\"3154\">\n<li class=\"\" data-start=\"2155\" data-end=\"2386\">\n<p class=\"\" data-start=\"2157\" data-end=\"2386\"><strong data-start=\"2157\" data-end=\"2184\">Increased wear and tear<\/strong> \u2013 Four animals in a home is not a small matter. Scratches on floors, pet odours, chewing damage, and backyard destruction aren\u2019t theoretical\u2014they\u2019re real maintenance issues, often expensive to rectify.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2387\" data-end=\"2570\">\n<p class=\"\" data-start=\"2389\" data-end=\"2570\"><strong data-start=\"2389\" data-end=\"2413\">Neighbour complaints<\/strong> \u2013 Properties with multiple pets increase noise, potential aggression issues, and even the risk of allergies or phobias in neighbouring tenants or residents. <!-- BODY -->\r\n<!-- \/21854739906\/PMAll \r\n<div class='gam-all googlead' id='div-gpt-ad-1591955561642-0' style='width: 320px; height: 480px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1591955561642-0'); });\r\n  <\/script>\r\n<\/div> -->\r\n\r\n<div class=\"adplugg-tag\" data-adplugg-zone=\"property_management_body_\"><\/div><\/p>\n<\/li>\n<li class=\"\" data-start=\"2571\" data-end=\"2729\">\n<p class=\"\" data-start=\"2573\" data-end=\"2729\"><strong data-start=\"2573\" data-end=\"2595\">Insurance concerns<\/strong> \u2013 Many landlord insurance policies don\u2019t cover damage caused by pets\u2014or if they do, they impose stricter premium costs or exclusions.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2730\" data-end=\"2971\">\n<p class=\"\" data-start=\"2732\" data-end=\"2971\"><strong data-start=\"2732\" data-end=\"2748\">Dispute risk<\/strong> \u2013 The term \u201creasonable\u201d now becomes a legal battleground. If you object to four pets, you'll likely have to plead your case before NCAT. And we all know how time-consuming, stressful, and unpredictable that process can be.<\/p>\n<\/li>\n<li class=\"\" data-start=\"2972\" data-end=\"3154\">\n<p class=\"\" data-start=\"2974\" data-end=\"3154\"><strong data-start=\"2974\" data-end=\"2993\">Exit strategies<\/strong> \u2013 For landlords who might want to sell their property or repurpose it, pet damage or entrenched pet tenancies may reduce appeal or limit options for renovation.<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"3156\" data-end=\"3328\">This is not about being anti-pet.<\/p>\n<p class=\"\" data-start=\"3156\" data-end=\"3328\">Many landlords already allow pets, on a negotiated, case-by-case basis.<\/p>\n<p class=\"\" data-start=\"3156\" data-end=\"3328\">The key difference now is <strong data-start=\"3288\" data-end=\"3299\">control<\/strong>\u2014investors no longer have it.<\/p>\n<h2 data-start=\"3156\" data-end=\"3328\"><span class=\"toc_link\" id=\"and-the-consequences-predictable-and-dangerous\">And the consequences? Predictable and Dangerous<\/span><\/h2>\n<p class=\"\" data-start=\"3388\" data-end=\"3488\">What happens when investors are stripped of rights, while their responsibilities and costs increase?<\/p>\n<p class=\"\" data-start=\"3490\" data-end=\"3500\">They exit.<\/p>\n<p class=\"\" data-start=\"3502\" data-end=\"3802\">We\u2019re already seeing it.<\/p>\n<p class=\"\" data-start=\"3502\" data-end=\"3802\">Investors have been pulling out of the market since whispers of this reform began.<\/p>\n<p class=\"\" data-start=\"3502\" data-end=\"3802\">This new regulation just accelerates the trend.<\/p>\n<p class=\"\" data-start=\"3502\" data-end=\"3802\">In fact, Tim McKibbin, CEO of the Real Estate Institute of NSW, warns this will lead to a <strong data-start=\"3748\" data-end=\"3778\">\u201cmass exodus\u201d of landlords<\/strong> from the rental market.<\/p>\n<p class=\"\" data-start=\"3804\" data-end=\"3950\">And we don\u2019t need a crystal ball to know what that means: <em data-start=\"3862\" data-end=\"3887\">fewer rental properties<\/em>, <em data-start=\"3889\" data-end=\"3917\">even tighter vacancy rates<\/em>, and <em data-start=\"3923\" data-end=\"3949\">rents pushed even higher<\/em>.<\/p>\n<p class=\"\" data-start=\"3952\" data-end=\"4165\">The irony is bitter.<\/p>\n<p class=\"\" data-start=\"3952\" data-end=\"4165\">In an attempt to improve tenant conditions, the government has created a policy that will likely <strong data-start=\"4070\" data-end=\"4111\">worsen the rental crisis for everyone, <\/strong>especially the very renters they claim to be helping.<\/p>\n<h2 data-start=\"3952\" data-end=\"4165\"><span class=\"toc_link\" id=\"government-overreach-or-political-performance\">Government overreach or political performance?<\/span><\/h2>\n<p class=\"\" data-start=\"4224\" data-end=\"4478\">Let\u2019s not kid ourselves.<\/p>\n<p class=\"\" data-start=\"4224\" data-end=\"4478\">This reform isn\u2019t about solving the housing crisis.<\/p>\n<p class=\"\" data-start=\"4224\" data-end=\"4478\">It\u2019s about short-term political gain.<\/p>\n<p class=\"\" data-start=\"4224\" data-end=\"4478\">It panders to tenant advocacy groups and builds populist sentiment among pet lovers.<\/p>\n<p class=\"\" data-start=\"4224\" data-end=\"4478\">It\u2019s a feel-good headline: \u201cTenants Can Now Have Pets!\u201d<\/p>\n<p class=\"\" data-start=\"4480\" data-end=\"4627\">But beneath the surface, it\u2019s another demonstration that private investors are being sidelined from housing policy decisions.<\/p>\n<p class=\"\" data-start=\"4480\" data-end=\"4627\">And that\u2019s a mistake.<\/p>\n<p class=\"\" data-start=\"4629\" data-end=\"4775\">Investors provide over 90% of Australia\u2019s rental housing.<\/p>\n<p class=\"\" data-start=\"4629\" data-end=\"4775\">You cannot fix the rental market by punishing them.<\/p>\n<p class=\"\" data-start=\"4629\" data-end=\"4775\">Yet that\u2019s exactly what\u2019s happening.<\/p>\n<p class=\"\" data-start=\"4777\" data-end=\"4945\">As McKibbin put it:<\/p>\n<blockquote>\n<p class=\"\" data-start=\"4777\" data-end=\"4945\">\u201cThe Government has assumed responsibility for housing tenants by driving investors out\u2026 but where are the homes going to come from?\u201d<\/p>\n<\/blockquote>\n<p class=\"\" data-start=\"4777\" data-end=\"4945\">Good question.<\/p>\n<p data-start=\"4777\" data-end=\"4945\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-158923 data-end=\"4945\"><span class=\"toc_link\" id=\"a-better-way-forward\">A better way forward<\/span><\/h2>\n<p class=\"\" data-start=\"4978\" data-end=\"5134\">Nobody is saying tenants shouldn\u2019t be able to own pets.<\/p>\n<p class=\"\" data-start=\"4978\" data-end=\"5134\">But as with most things in life, balance is key.<\/p>\n<p class=\"\" data-start=\"4978\" data-end=\"5134\">A more sustainable and fair approach could include:<\/p>\n<ul data-start=\"5136\" data-end=\"5475\">\n<li class=\"\" data-start=\"5136\" data-end=\"5186\">\n<p class=\"\" data-start=\"5138\" data-end=\"5186\"><strong data-start=\"5138\" data-end=\"5160\">Optional pet bonds<\/strong> to cover potential damage<\/p>\n<\/li>\n<li class=\"\" data-start=\"5187\" data-end=\"5269\">\n<p class=\"\" data-start=\"5189\" data-end=\"5269\"><strong data-start=\"5189\" data-end=\"5253\">Clearer definitions of what constitutes \u2018reasonable grounds\u2019<\/strong> for pet refusal<\/p>\n<\/li>\n<li class=\"\" data-start=\"5270\" data-end=\"5369\">\n<p class=\"\" data-start=\"5272\" data-end=\"5369\"><strong data-start=\"5272\" data-end=\"5330\">Support for investors making pet-related modifications<\/strong>, possibly via tax offsets or subsidies<\/p>\n<\/li>\n<li class=\"\" data-start=\"5370\" data-end=\"5475\">\n<p class=\"\" data-start=\"5372\" data-end=\"5475\"><strong data-start=\"5372\" data-end=\"5413\">Greater clarity in insurance coverage<\/strong>, with government and insurers working together to reduce risk<\/p>\n<\/li>\n<\/ul>\n<p class=\"\" data-start=\"5477\" data-end=\"5677\">The real solution lies in collaboration, not coercion.<\/p>\n<p class=\"\" data-start=\"5477\" data-end=\"5677\">Investors, tenants, government\u2014each is a stakeholder.<\/p>\n<p class=\"\" data-start=\"5477\" data-end=\"5677\">Yet too often, landlords are treated as a faceless obstacle rather than part of the answer.<\/p>\n<h2 data-start=\"5477\" data-end=\"5677\"><span class=\"toc_link\" id=\"the-bottom-line\">The bottom line<\/span><\/h2>\n<p class=\"\" data-start=\"5705\" data-end=\"5963\">The NSW Government\u2019s pet reform might play well in the polls, but it\u2019s a disaster for investor confidence.<\/p>\n<p class=\"\" data-start=\"5705\" data-end=\"5963\">And it couldn\u2019t have come at a worse time.<\/p>\n<p class=\"\" data-start=\"5705\" data-end=\"5963\">With construction delays, record migration, and spiralling living costs, we need more rental stock, not less.<\/p>\n<p class=\"\" data-start=\"5965\" data-end=\"6075\">But instead of encouraging more supply, the message to investors is loud and clear: \u201cYou\u2019re not welcome here.\u201d<\/p>\n<p class=\"\" data-start=\"6077\" data-end=\"6149\">And when landlords walk away, tenants are the ones who\u2019ll pay the price.<\/p>\n<p class=\"\" data-start=\"6151\" data-end=\"6320\">If this trend continues, we\u2019re not just talking about a pet problem.<\/p>\n<p class=\"\" data-start=\"6151\" data-end=\"6320\">We\u2019re talking about a policy problem that could push the state\u2019s rental market to breaking point.<\/p>\n<p data-start=\"6151\" data-end=\"6320\">\r\n<!-- \/21854739906\/PMDiff \r\n<div class='gam-diff googlead' id='div-gpt-ad-1591955248601-0'>\r\n  <script>\r\n
