{"id":35410,"date":"2022-12-22T14:00:28","date_gmt":"2022-12-22T03:00:28","guid":{"rendered":"http:\/\/propertyupdate.com.au\/?p=35410"},"modified":"2022-12-24T00:59:53","modified_gmt":"2022-12-23T13:59:53","slug":"cooling-period-garth-brown","status":"publish","type":"post","link":"https:\/\/propertyupdate.com.au\/cooling-period-garth-brown\/","title":{"rendered":"What is the cooling-off period for property purchase?"},"content":{"rendered":"<p><strong>When you buy a residential property in NSW there is a five business-day cooling-off period after you exchange sale contracts.<\/strong><\/p>\n<p>During this period you have the option to get out of the contract as long as you give written notice.<\/p>\n<p>The cooling-off period starts as soon as you exchange and ends at 5pm on the fifth business day.<\/p>\n<div class=\"notes\"><div class=\"notes-inner\"><span class=\"icon\"><picture><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/propertyupdate.com.au\/wp-content\/themes\/oldpaper\/img\/note.svg\" alt=\"pencil icon\"><\/picture><\/span><p><span class=\"tips-notes\">Note: <\/span>A cooling-off period does not apply if you buy a property at auction or exchange contracts on the same day as the auction after it is passed in.<\/p><\/div><\/div>\n<p><strong>You can waive the cooling-off period by giving the\u00a0seller a\u00a0\u2018<a href=\"https:\/\/legalvision.com.au\/section-66w-certificate\/\">66W certificate<\/a>\u2019.<\/strong><\/p>\n<p>This is a certificate that complies with Section 66W of the <i><a href=\"https:\/\/legislation.nsw.gov.au\/view\/html\/inforce\/current\/act-1919-006\">Conveyancing Act 1919<\/a>.<\/i><\/p>\n<p>The certificate needs to be signed by your <a href=\"https:\/\/propertyupdate.com.au\/conveyancing-step-by-step\/\">solicitor or conveyancer<\/a>.<\/p>\n<p>If you use your cooling-off rights and withdraw from the contract during the five business-day period, you will have to pay the seller 0.25% of the purchase price.<\/p>\n<p><strong>This works out to be $250 for every $100,000.<\/strong><\/p>\n<p>Sometimes, there are more buyers looking for homes than there are properties on the market<\/p>\n<p>This is called a sellers\u2019\u00a0market.<\/p>\n<p>In this case, you may want to organise a quick contract exchange.<\/p>\n<p>This way you can reduce the possibility of someone beating your offer and get your building and pest inspections done during the cooling-off period.<\/p>\n<p>You will still be able to back out if there is a problem.<\/p>\n<p>However, it is important to have the contract checked by your solicitor or conveyancer before you sign it.<\/p>\n<p>Please refer <a href=\"https:\/\/www.fairtrading.nsw.gov.au\/housing-and-property\/buying-and-selling-property\/buying-a-property\/contracts-and-deposits\">NSW Fair Trading website<\/a>.<\/p>\n<h2><span class=\"toc_link\" id=\"why-isit-applied-to-purchasers-only\">Why is\u00a0it applied to purchasers only?<\/span><\/h2>\n<p>A <b>\u201ccooling-off\u201d period<\/b> is part of a legally binding contract and in Real Estate it has implications for the Purchaser (ONLY) to act within that period if they decide not to proceed with the contract.<\/p>\n<div class=\"notes\"><div class=\"notes-inner\"><span class=\"icon\"><picture><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/propertyupdate.com.au\/wp-content\/themes\/oldpaper\/img\/note.svg\" alt=\"pencil icon\"><\/picture><\/span><p><span class=\"tips-notes\">Note: <\/span>It does not apply for the Seller.<\/p><\/div><\/div>\n<p>When you buy goods or services from a trader, you are entering into a contract.<\/p>\n<p>Before you do, make sure you understand what you are agreeing to, remember \u2026<\/p>\n<p>A contract is an agreement made between two or more parties that is legally enforceable.<\/p>\n<p>A contract arises when one party makes an offer and the other party communicates an intention to accept it. Contracts can be in writing or made verbally.<\/p>\n<p><strong>You could be entering a contract by:<\/strong><b><\/b><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Signing a document<\/li>\n<li>Selecting a\u00a0product in\u00a0a shop\u00a0and paying for it at the check-out counter<\/li>\n<li>Clicking on an 'I agree' button on a web page.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>It is also unlawful for traders to act force or coerce you into entering a contract.<\/p>\n<p>For more information <a href=\"http:\/\/www.accc.gov.au\/content\/index.phtml\/itemId\/3634\" target=\"_blank\" rel=\"noopener\">contact the ACCC<\/a>.<\/p>\n<h2><span class=\"toc_link\" id=\"colling-off-period-rules\">Colling-off period rules<\/span><\/h2>\n<p><b>A 'cooling-off' period<\/b> is a safeguard designed to give the Purchaser the opportunity to change their mind about a purchase or agreement that they have made within a specified timeframe.<\/p>\n<p>You have a right to a <b>\u201ccooling-off period\u201d<\/b> when you purchase goods or services through door-to-door sales, telemarketing and of course Real Estate.<\/p>\n<p>Most purchasers have the right to get out of the contract in certain circumstances this is called a <b>\"cooling-off period\"<\/b> (check the law in your State or Territory - the laws are not consistent and do not exist in each State or Territory).<\/p>\n<p>Make sure you know whether you have this right at the time ANY type of contract is signed - and how you can assert this right if you need to.<\/p>\n<p>The rules about \u201c<b>cooling-off periods\u201d<\/b> vary depending on the State or Territory law.<\/p>\n<p><strong>In general, they only apply when:<\/strong><\/p>\n<ul>\n<li>There are a defined number of <b>\u2018clear business days\u2019<\/b> after the contract is\u00a0signed<\/li>\n<li>There is a private sale, not an auction<\/li>\n<li>It is domestic property, it does not apply to a <a href=\"\/commercial-property-a-property-investors-guide\/\">commercial property<\/a> or a farm<\/li>\n<\/ul>\n<h2><span class=\"toc_link\" id=\"what-are-clear-business-days\">What are clear business days?<\/span><\/h2>\n<p>These days begin at midnight of the day you signed the <a href=\"https:\/\/www.fairtrading.nsw.gov.au\/housing-and-property\/property-professionals\/working-as-a-property-agent\/sales-contracts\">Contract of Sale<\/a> or Contract Note, it includes business days only, it does not include a Saturday, Sunday or public holiday.<\/p>\n<p>It is important to note that it runs from the time you sign the contract NOT from when the seller signs.<\/p>\n<p>In Real Estate the Purchaser (only) usually has five business days after the date of the Contract to carry out <b>searches, pest &amp; Building reports, title insurance, formal finance approval; <\/b>the property is effectively removed from the market and no other purchaser can secure the property during these five business days.<\/p>\n<p>If the Buyer finds problems with the property or finance - he can exit the contract prior to 5 pm on the fifth business day after signing the Contract.<\/p>\n<div class=\"notes\"><div class=\"notes-inner\"><span class=\"icon\"><picture><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/propertyupdate.com.au\/wp-content\/themes\/oldpaper\/img\/note.svg\" alt=\"pencil icon\"><\/picture><\/span><p><span class=\"tips-notes\">Note: <\/span>Not all Vendors agree to a \u201ccooling off period\u201d.<\/p><\/div><\/div>\n<p>The Seller must return the deposit, less up to 0.25 per cent of the property\u2019s purchase price.<\/p>\n<p><div class=\"tips\"><div class=\"tips-inner\"><span class=\"icon\"><picture><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/propertyupdate.com.au\/wp-content\/themes\/oldpaper\/img\/bulb.svg\" alt=\"bulb icon\"><\/picture><\/span><p><span class=\"tips-notes\">Tip: <\/span>It\u2019s wise to ask the agent <i>\u2013 <\/i><em>\u201cwill the Vendor accept a cooling-off period when making the Offer?\"<\/em><br \/>\nKeep in mind: A cooling-off period does not apply at Auction or where contracts exchange on the same day after the auction property is passed in.<\/p><\/div><\/div><br \/>\n<aside><strong style=\"clear: both;
