{"id":71889,"date":"2024-10-26T10:00:00","date_gmt":"2024-10-25T23:00:00","guid":{"rendered":"http:\/\/propertyupdate.com.au\/?p=71889"},"modified":"2025-02-21T02:54:15","modified_gmt":"2025-02-20T15:54:15","slug":"need-know-debt-death","status":"publish","type":"post","link":"https:\/\/propertyupdate.com.au\/need-know-debt-death\/","title":{"rendered":"What you need to know about debt after death"},"content":{"rendered":"<p><strong>What happens to your loans and debts when you die?<\/strong><\/p>\n<p>It\u2019s probably not something you\u2019ve given much thought to, but understanding the way debt works after we pass on is important for all investors to consider, so as to ensure that our loved ones are financially taken care of \u2013 and not burdened \u2013 afterwards.<\/p>\n<p>Of course death is not a nice thing to think about, but it\u2019s important to be proactive and to plan for the future.<\/p>\n<div class=\"notes\"><div class=\"notes-inner\"><span class=\"icon\"><picture><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/propertyupdate.com.au\/wp-content\/themes\/oldpaper\/img\/note.svg\" alt=\"pencil icon\"><\/picture><\/span><p><span class=\"tips-notes\">Note: <\/span>Remember, being prepared (and making sure your loved ones are too) will make the process far less stressful and less costly in the long run.<\/p><\/div><\/div>\n<p>There is a standard procedure for dealing with debt after death, so here\u2019s what you need to know about what will happen, and how to prepare in advance for some common issues that your family members may face.<\/p>\n<h2><span class=\"toc_link\" id=\"what-happens-to-your-debt-after-you-die\">What happens to your debt after you die?<\/span><\/h2>\n<p>The general rule is that your debt, whether it be a mortgage, private loans, credit card debt or car loans, will need to be paid back.<\/p>\n<p>In most cases, the appointed executor of the estate will use the deceased\u2019s assets to see to this.<\/p>\n<p><strong>With unpaid mortgages here\u2019s what you can expect:<\/strong><\/p>\n<p>Ordinarily, the executor of your will will use your estate to pay off the mortgage.\u00a0<!-- BODY -->\r\n<!-- \/21854739906\/BooksAll \r\n<div class='gam-all googlead' id='div-gpt-ad-1591967275697-0'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1591967275697-0'); });\r\n  <\/script>\r\n<\/div> -->\r\n\r\n<div class=\"adplugg-tag\" data-adplugg-zone=\"books_of_michael_yardney_body_\"><\/div><\/p>\n<ul>\n<li>In the event that there is a substantial amount of money within the estate to pay off the mortgage, the inheritors may elect to keep the property which is mortgaged.<\/li>\n<li>It is also possible for a relative, nominated in the will, to legally inherit and take ownership of the house. In this circumstance, notifying the lender may allow them to assume your mortgage.<\/li>\n<li>It is also possible that a mortgage may be paid out from proceeds of a life insurance policy.<\/li>\n<\/ul>\n<p>In the event that your estate can\u2019t pay off the mortgage and the inheritors can\u2019t afford it either, the beneficiaries of your will generally opt to sell the property, pay off the debt using the proceeds of the sale and distribute the balance in a way requested in your will.<\/p>\n<h2><span class=\"toc_link\" id=\"will-any-of-your-debts-be-payable-by-your-family\">Will any of your debts be payable by your family?<\/span><\/h2>\n<p>Other people are <em>only<\/em> responsible for repaying your debts after you die if one of the following scenarios is true:<\/p>\n<ul>\n<li>The debt is in joint names with someone else, such as a home co-owned by husband and wife.<\/li>\n<li>The debt is secured against a particular asset owned by someone else, such as a husband and wife\u2019s joint loan, secured against a property owned by the surviving spouse.<\/li>\n<li>Someone has guaranteed the debt.<\/li>\n<\/ul>\n<h2><span class=\"toc_link\" id=\"what-do-you-need-to-organise\">What do you need to organise?<\/span><\/h2>\n<p>To create as little hassle as possible for your relatives, it\u2019s essential that you pre-elect the executor of your estate.<\/p>\n<p><!-- BODY -->\r\n<!-- \/21854739906\/WAAll \r\n<div class='gam-all googlead' id='div-gpt-ad-1591954430768-0' style='width: 300px; height: 250px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1591954430768-0'); });\r\n  <\/script>\r\n<\/div> -->\r\n\r\n<div class=\"adplugg-tag\" data-adplugg-zone=\"wealth_advisory_body_\"><\/div>This is normally done upon creation of your will.<\/p>\n<p>Ensure that the executor is willing to take on the responsibility.<\/p>\n<p>If a suitable executor can\u2019t be found, you may choose your accountant, solicitor or public trustee company.<\/p>\n<p>Make sure that your will is regularly updated and that your wishes are clear.<\/p>\n<p>Discuss any outstanding debts with you lawyer and let your family members know what the procedures will be.<\/p>\n<p>For example, if you would like a relative to take ownership of your house and assume the mortgage, clearly state this in your will, leaving no room for interpretation.<\/p>\n<h2><span class=\"toc_link\" id=\"what-else-do-your-family-members-need-to-watch-out-for\">What else do your family members need to watch out for?<\/span><\/h2>\n<p>There are a few potential scenarios that you don\u2019t want to burden your loved ones with:<\/p>\n<ul>\n<li><strong>Joint debts.<\/strong> In the event that a relative co-signed on a credit card debt or loan, they will be liable to pay it off even after death of the co-signee.<\/li>\n<li><strong>Authorised user accounts.<\/strong> \u2018Authorised users\u2019 on credit cards are not responsible for paying the card holder\u2019s outstanding debts, however, remaining attached to this account may impact their credit score. So it makes sense that the authorised user contacts the lender and request removal from this account.<\/li>\n<li><strong>Joint tenants vs tenants in common.<\/strong> If you co-own a property with someone as a of one \u201cJoint Tenant\u201d rather than the more usual tenants in common the surviving Joint Tenant or tenants acquire the whole property automatically by operation of law. It follows that property held in joint tenancy does not form part of the estate of the tenant who dies.
