These documents are needed to protect the Purhaser.<\/p>\n<h2><span class=\"toc_link\" id=\"list-of-prescribed-documents\">List of prescribed documents<\/span><\/h2>\n<ul>\n<li>Section 149 (2) Certificate \u2013 (Council zoning of land, residential or commercial etc.)<\/li>\n<li>Service Drainage Diagram \u2013 (Location of services)<\/li>\n<li>Title &amp; Title notations \u2013 (Owners &amp; restrictions on Land use)<\/li>\n<li>Deposit Plan or Strata Plan \u2013 (Location of Lot)<\/li>\n<\/ul>\n<p><div class=\"notes\"><div class=\"notes-inner\"><span class=\"icon\"><picture><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/propertyupdate.com.au\/wp-content\/themes\/oldpaper\/img\/note.svg\" alt=\"pencil icon\"><\/picture><\/span><p><span class=\"tips-notes\">Note: <\/span>I<span style=\"font-size: 16px;\">n New South Wales it is <strong>compulsory<\/strong> for the agent to have a copy of the Schedule 1 Prescribed Documents with the Contract of Sale BEFORE they can market the property in accordance with the Conveyancing (Sale of Land) Regulation 2010 (NSW).<\/p><\/div><\/div><\/span><\/p>\n<h2><span class=\"toc_link\" id=\"what-happens-if-the-prescribed-documents-are-not-attached\">What happens if the prescribed documents are not attached?<\/span><\/h2>\n<p><div class=\"adplugg-tag\" data-adplugg-zone=\"home_sellers_protection_pack_body_\"><\/div>The Conveyancing Act and Conveyancing (Sale of Land) Regulations provide that if the Prescribed Documents are not included in the sale of a land contract, the buyer may rescind (pull out of) the contract for the seller\u2019s failure to attach to the contract the documents prescribed at any time within 14 days after the making of the contract unless the contract has been completed.<\/p>\n<p>Although under the general law and the Conveyancing (Sale of Land) Regulation 2010 (NSW) there are significant disclosure requirements on vendors in that vendors need to disclose \u201cprescribed documents\u201d, a purchaser should, after the exchange, make enquiries to determine whether any of the \u201cprescribed warranties\u201d have been breached \u2013 e.g. unapproved Council Structures or Boundary disputes.<\/p>\n<div class=\"notes\"><div class=\"notes-inner\"><span class=\"icon\"><picture><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/propertyupdate.com.au\/wp-content\/themes\/oldpaper\/img\/note.svg\" alt=\"pencil icon\"><\/picture><\/span><p><span class=\"tips-notes\">Note: <\/span>If a Contract of Sale is exchanged in haste sometimes by Sales Agents \u2013 and any of the Prescribed Documents are missing \u2013 the Purchaser can rescind the Contract within 14 days of the exchange of Contracts (under the Conveyancing Sale of Land Act) And if Standard Conditions are not present the Purchaser can rescind the Contract anytime up to Settlement \u2013 been established by case law.<\/p><\/div><\/div>\n<section id=\"image-carousel\" class=\"splide\" aria-label=\"Beautiful Images\"><div class=\"splide__track\"><ul class=\"splide__list\"><li class=\"splide__slide\"><a href=\"https:\/\/propertyupdate.com.au\/everything-you-need-to-know-about-the-state-of-australias-property-markets-in-charts\/\" class=\"also-read-title-block\"><span class=\"also-read-pre-title\">Also read:<\/span><span class=\"also-read-title\">Everything you need to know about the state of Australia\u2019s property markets in 20 charts \u2013 May 2025<\/span><\/a><img decoding=\"async\" sizes=\"100vw\" class=\"slider-image\" src=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2025\/05\/Property-markets-around-Australia-375x275.png\" data-splide-lazy=\"https:\/\/cdn.propertyupdate.com.au\/wp-content\/uploads\/2025\/05\/Property-markets-around-Australia-375x275.png\" alt=\"slider image\" loading=\"lazy\"><\/li><li class=\"splide__slide\"><a href=\"https:\/\/propertyupdate.com.au\/australian-property-market-predictions\/\" class=\"also-read-title-block\"><span class=\"also-read-pre-title\">Also read:<\/span><span class=\"also-read-title\">Latest property price forecasts for 2025 revealed.
